Use of Trademarks.

A model railroad supplier in the US won a suit brought against it by the Union Pacific Railroad for use of its trademark. The Union Pacific lost this lawsuit. Use of a trademark on a historical model of a ship probably falls under fair use of a trade mark. Other countries may view this differently.

In my experience most content I have seen created is usually the work of a sole artist. 3D canvas has an object library feature that would allow you to save selected items into a library and use in new scenes. I am sure the much more expensive 3DS Max has the same features.

Insofar as the content creation I would like to see us content creators be able to get together as a team and work on a sole project. FTP servors could bridge this gap. A project could be loaded on an FTP servor and signed out one at a time by a 3D artist on one day updated and on another day another artist loads up the project and works on it.

Again all my experience in content creation is in train simulators however; I have seen projects in Train-sim that bog down and are never completed because they were just to much work for one person "Steam Locomotives" are the big bugaboo for train simmers. Creating Vessels looks like a project to me that could eat your head off.

Hi Howard,

I'm no legal expert, so trademarks are not something I can shine a light on...  :)

But as far as your idea of 'teaming up' goes, to combine, and benefit from, multiple skills that several people together might have, to lighten the workload and to work more efficient and faster, and succesfully deliver a product that actually can be used, I could not agree more. I've been suggesting this for a long time. Solo projects are very difficult, and a good modeler isn't necessarily a good texture creating artist, or programmer, or knows about ship dynamics, researcher, you name it..  Teamwork to cover all the bases is the best method in my humble opinion.

Fellow administrator Terry Russell and myself have been setting up something along those lines, where we intend to make a great variety of static objects for the game, focussing on navigational aids mostly, like buoys, beacons, signs, lighthouses, lightships, and various other ojects like that. There are a few more modelers who also were very interested and joined us to help out, aswell.

If you are interested in doing some brainstorming, or planning something like this, I'd be keen to see what we can come up with! Drop me a line if you want to get into this perhaps, or if you like to know more about the project we intend to do, and such.

Hoy Howard&Fred,
Maybe we must find a laywer in our mids.
Than he can maybe shine the light a bit brighter on this matter.
What is true is this that by creation of the "Vermaas"containervessel,is a real ship only they've made some differences.specialy for this matter.
This is also the reason that the ship"Berge Stahl"has been in the game to(up intill today).
We've tryed to get intough with the B&W company,also up untill today with no reaction of them.

hello all,

I know this is a dead topic but I would like to add something about the Model Railroading issue.

I am no lawyer but, as a model railroader, U.P. and the Model Railroading Industry kinda made an agreement about the logos for railroads that no longer exist such as Southern Pacific, Nickle Plate and so forth.  Companies that make the rolling stock and engines identify who currently owns what.  This is done by mergers that were done in the past.  In a catalog for a company that makes an engine with the Southern Pacific logo, will have a footnote saying it is owned by Union Pacific.  U.P. and S.P. merged a while back and U.P. now owns all of the trademark name S.P. owned.  Plus I think there was a one time royalty paid for the use of different logos.  There is alot more about this and what U.P. was after...

I do not know how the Marine Industry would react by people making models of ships with trademarked shipping companies logos.  Since I am a marine drafter, container, RO-RO, RO-CON, LNG and Oil tankers, I have access to actual ship drawings and 3D models, I know some of them, ship owners, can be very touchy about their ship designs and drawings.   I would not hurt to asked any company if there logos and paint schemes could be used.
